these terms govern your use of the fenda studio website and the purchase of our pieces. by placing an order or using our website, you agree to these terms.

1. about fenda studio

fenda studio is an independent jewellery studio based in Haarlem, the Netherlands, offering handcrafted, made-to-order pieces. all transactions are conducted in euros. for customers outside the eurozone, your bank or payment provider will apply the applicable exchange rate at the time of purchase.

2. orders and payment

placing an order by completing a purchase, you confirm that you are authorised to use the payment method provided and that the information submitted is accurate. all orders are subject to acceptance and availability.

pricing all prices are listed in euros. where applicable, VAT is included in accordance with Dutch and EU law.

customers outside the European Union are responsible for any duties, taxes, or import charges in their own country. prices are subject to change without notice, but changes will not affect orders already confirmed.

payment payment is processed at the time of order. we accept major credit and debit cards and other payment methods listed at checkout. if a payment is declined or reversed, we reserve the right to cancel the associated order.

order cancellation and the right of withdrawal each fenda piece is made to order, formed to specification from the moment production begins. under EU consumer law, the standard right of withdrawal does not apply to goods made to a customer's specifications, as such pieces cannot reasonably be resold.

as a courtesy, we allow cancellation within 24 hours of ordering, before production begins. after this window, or once work has commenced on a custom or commissioned piece, orders cannot be cancelled or refunded.

3. production and delivery

all fenda pieces are made to order. production timelines, shipping methods, and delivery estimates are outlined in our shipping and returns policy, which forms part of these terms.

once a parcel has been collected by the carrier, fenda studio is not responsible for transit delays, lost parcels, or customs processing. we will always assist where we can.

4. returns, exchanges and resizing

our returns, exchanges, and resizing policy is detailed in our shipping and returns document, which forms part of these terms. by placing an order, you acknowledge and accept those conditions.

5. intellectual property

all content on the fenda studio website, including designs, photography, copy, brand assets, and product imagery, is the intellectual property of fenda studio and may not be reproduced, distributed, or used without prior written permission.

our jewellery designs are original work. unauthorised reproduction or copying of our designs, in whole or in part, is prohibited.

6. limitation of liability

to the fullest extent permitted by Dutch law, fenda studio's liability for any claim arising from the purchase or use of our products is limited to the value of the relevant order.

we are not liable for indirect, incidental, or consequential losses, including loss of income, data, or enjoyment, arising from your use of our website or products.

nothing in these terms limits any rights you may have under Dutch or EU consumer law that cannot be excluded by contract.

7. your legal guarantee

our products come with a legal guarantee of conformity under Dutch and EU law. if a product does not conform to the contract, you are entitled to repair, replacement, or, where appropriate, a price reduction or refund, within the statutory guarantee period.

8. privacy

we collect and handle your personal information in accordance with our privacy policy, which is available on our website and forms part of these terms.

9. governing law

these terms are governed by the laws of the Netherlands. any disputes arising from these terms or your purchase are subject to the exclusive jurisdiction of the competent court in Amsterdam.

10. changes to these terms

we may update these terms from time to time. the current version is always available on our website. continued use of our site or services after an update constitutes acceptance of the revised terms.

1. information we collect

information you provide when you place an order, create an account, or contact us, we may collect your name, email address, phone number, shipping and billing address, and payment details. payment is processed securely through our payment provider - we do not store full card details.

information collected automatically when you visit our website, we may collect data about your browser, device, IP address, and how you interact with our site. this is done through cookies and analytics tools, including Google Analytics and Shopify's built-in analytics.

communications if you contact us directly, we retain a record of that correspondence to assist with your enquiry.

2. how we use your information

we use your information to process and fulfil your orders, communicate with you about your purchase, send tracking and order updates, respond to enquiries, and improve our website and customer experience.

with your consent, we may send occasional updates about new work, events, or releases. you can unsubscribe at any time.

3. legal basis for processing

we process your information on the following grounds: performance of a contract, consent for marketing communications, and legitimate interest in improving our website and preventing fraud.

4. sharing your information

we do not sell your personal information. we share it only where necessary to fulfil your order or operate our business - with our shipping partners, PostNL and DHL, our payment processors, and our e-commerce platform, Shopify.

these third parties are bound by their own privacy policies and may only use your information to provide their services to us.

5. international transfers

fenda studio is based in the Netherlands. where your information is transferred outside the European Economic Area, we ensure appropriate safeguards are in place, such as standard contractual clauses approved by the European Commission.

our website uses cookies to enable core functionality, remember your preferences, and understand how visitors use our site. you can manage or disable cookies through your browser settings, though some features may not function correctly without them.

7. data retention

we retain your information for as long as necessary to fulfil the purposes outlined in this policy, meet our legal obligations, and resolve any disputes. order and financial records are retained for seven years in accordance with Dutch tax law.

under the GDPR, you have the right to access the personal information we hold about you, request corrections to inaccurate information, request erasure where it is no longer needed, object to or restrict certain processing, and request a copy of your data in a portable format.

you also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you believe your information has been mishandled.
