these terms govern your use of the fenda studio website and the purchase of our pieces. by placing an order or using our website, you agree to these terms.

1. about fenda studio

fenda studio is an independent jewellery studio based in haarlem, the netherlands, offering handcrafted, made-to-order pieces, registered with the dutch chamber of commerce under number 42114326 and registered for VAT under BTW-id NL005518134B91. all transactions are conducted in euros. for customers outside the eurozone, your bank or payment provider will apply the applicable exchange rate at the time of purchase.

2. orders and payment

placing an order by completing a purchase, you confirm that you are authorised to use the payment method provided and that the information submitted is accurate. all orders are subject to acceptance and availability.

pricing all prices are listed in euros. where applicable, VAT is included in accordance with Dutch and EU law.

customers outside the European Union are responsible for any duties, taxes, or import charges in their own country. prices are subject to change without notice, but changes will not affect orders already confirmed.

payment payment is processed at the time of order. we accept major credit and debit cards and other payment methods listed at checkout. if a payment is declined or reversed, we reserve the right to cancel the associated order.

cancellation and the right of withdrawal collection pieces, ordered as offered on the site in one of the listed metals, sizes and options, carry a 14-day right of withdrawal from the day of delivery, as set out in our shipping and returns policy, together with the model withdrawal form. pieces made to your personal specification or clearly personalised, such as commissions, pieces developed around a stone selected individually with you or supplied by you, and engraving of your own words, are excluded from this right under EU consumer law. the studio confirms this in writing before work begins. any order may be cancelled free of charge before production begins.

3. production and delivery

all fenda pieces are made to order. the production time shown on a piece's page when you order is the agreed delivery time. shipping methods and delivery details are outlined in our shipping and returns policy, which forms part of these terms.

your order remains the responsibility of fenda studio until it is delivered to you or to a person you have named to receive it. if a parcel is lost or damaged in transit, the piece will be replaced or refunded in full. customs processing outside the EU is handled by the relevant authorities and may affect delivery times.

4. returns, exchanges and resizing

returns, exchanges and resizing are detailed in our shipping and returns policy, which forms part of these terms.

5. intellectual property

all content on the fenda studio website, including designs, photography, copy, brand assets, and product imagery, is the intellectual property of fenda studio and may not be reproduced, distributed, or used without prior written permission.

our jewellery designs are original work. unauthorised reproduction or copying of our designs, in whole or in part, is prohibited.

6. limitation of liability

to the extent permitted by Dutch law, fenda studio's liability for any claim arising from the purchase or use of our products is limited to the value of the relevant order. this limitation does not apply to damage caused intentionally or through gross negligence, or to personal injury.

we are not liable for indirect, incidental, or consequential losses, including loss of income, data, or enjoyment, arising from your use of our website or products.

nothing in these terms limits any rights you may have under Dutch or EU consumer law that cannot be excluded by contract.

7. your legal guarantee

our products come with a legal guarantee of conformity under Dutch and EU law. if a product does not conform to the contract, you are entitled to repair, replacement, or, where appropriate, a price reduction or refund, within the statutory guarantee period.

8. privacy

we collect and handle your personal information in accordance with our privacy policy, which is available on our website and forms part of these terms.

9. governing law

these terms are governed by the laws of the Netherlands. any dispute arising from these terms or your purchase is submitted to the court that has jurisdiction under the law. if you are a consumer, this choice of law does not take away the protection given to you by the mandatory consumer law of your country of residence, and you may also bring a claim before the courts there.

10. changes to these terms

we may update these terms from time to time. the current version is always available on our website. orders are governed by the terms in force when they were placed.

information you provide when you place an order, create an account, or contact us, we may collect your name, email address, phone number, shipping and billing address, and payment details. payment is processed securely through our payment provider - we do not store full card details.

information collected automatically when you visit our website, we may collect data about your browser, device, IP address, and how you interact with our site. this is done through cookies and analytics tools, including Google Analytics and Shopify's built-in analytics.

communications if you contact us directly, we retain a record of that correspondence to assist with your enquiry.

2. how we use your information

we use your information to process and fulfil your orders, communicate with you about your purchase, send tracking and order updates, respond to enquiries, and improve our website and customer experience.

with your consent, we may send occasional updates about new work, events, or releases. you can unsubscribe at any time.

3. legal basis for processing

we process your information on the following grounds: performance of a contract, consent for marketing communications, and legitimate interest in improving our website and preventing fraud.

4. sharing your information

we do not sell your personal information. we share it only where necessary to fulfil your order or operate our business - with our shipping partners, PostNL and DHL, our payment processors, and our e-commerce platform, Shopify.

these third parties are bound by their own privacy policies and may only use your information to provide their services to us.

5. international transfers

fenda studio is based in the Netherlands. where your information is transferred outside the European Economic Area, we ensure appropriate safeguards are in place, such as standard contractual clauses approved by the European Commission.

6. cookies

our website uses cookies to enable core functionality, remember your preferences, and understand how visitors use our site. you can manage or disable cookies through your browser settings, though some features may not function correctly without them.

7. data retention

we retain your information for as long as necessary to fulfil the purposes outlined in this policy, meet our legal obligations, and resolve any disputes. order and financial records are retained for seven years in accordance with Dutch tax law.

under the GDPR, you have the right to access the personal information we hold about you, request corrections to inaccurate information, request erasure where it is no longer needed, object to or restrict certain processing, and request a copy of your data in a portable format.

you also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you believe your information has been mishandled.

9. security
